Este año, el Índice de Percepción de la Corrupción dibuja un paisaje sombrío. La mayoría de los países evaluados no ha registrado ningún avance en la lucha contra la corrupción y más de dos tercios puntúan por debajo de 50. El análisis de Transparencia Internacional indica que la corrupción no solo socava la respuesta sanitaria global a la covid-19 sino que también contribuye a mantener la democracia en un estado de crisis permanente.

Covid-19 is posing unprecedented challenges to Latin America, including its efforts to combat corruption. All countries in the region have been forced to swiftly mobilize massive resources to fight the virus and to mitigate its economic fallout. Governments have been scrambling to import ventilators from around the globe, expand ICU capacity, roll out enormous financial stimulus packages, help large swathes of the private sector to stay afloat, and more. In this environment of emergency spending, relaxed controls and remote working, the risk of corruption and mismanagement of funds has increased.

The timing of the pandemic is also particularly troubling. covid-19 is hitting Latin America at a moment when the region-wide anti-corruption wave of recent years is losing force and, in some places, is dangerously receding.

Es indiscutible que en los últimos años se han dado en México avances significativos en la configuración de una estructura legal de protección de derechos humanos; materias como el acceso a la información, la protección de datos personales, la transparencia y la fiscalización son muestra de ello. Se han logrado reformas constitucionales, leyes secundarias, instituciones garantes y sistemas electrónicos que nos colocan en un lugar de avanzada en el escenario internacional. Estos logros se deben en gran medida al trabajo e impulso de la sociedad civil.

Por otro lado, también es innegable que el país se encuentra inmerso en una grave crisis, caracterizada por violaciones generalizadas a los derechos humanos, y alarmantes niveles de corrupción e impunidad. Esta paradoja se explica en buena medida por el hecho de que las reformas legales no se han traducido en instituciones operativas que respondan al interés de la ciudadanía. Por el contrario, los gobiernos estatales y federal han llevado a cabo una política sistemática de simulación del cumplimiento de las nuevas leyes, sin comprometerse realmente a cumplir los objetivos que las propiciaron.

Fragmento original: Almost five years into Latin America’s anti-corruption push, the region’s politics, business environment and civil society have been deeply transformed. The issue of corruption shaped elections last year in the two largest Latin American economies—Mexico and Brazil—and it still dominates the political conversation almost everywhere in the region. From the collapse of infrastructure projects across the region to the rapid growth of a new compliance industry, governments and the private sector are being forced to adapt to a different reality. Meanwhile, the media, academia and NGOs have been instrumental in pushing the movement forward, while cautioning against dangerous unintended consequences—particularly the rise of populism and judicial overreach.

Fragmento original: Civil society organizations across Europe are campaigning for a European-wide directive on whistleblowing. This would ensure that there is a streamlined, clear system in place to both hear and protect those who are compelled to blow the whistle on activities within their organization that they believe endanger the common good. While it has become widely accepted that whistleblowers play an important role in an open society, right now, in Europe, protections are varied dependent on the country in which a potential whistleblower lives, if, indeed, they exist at all.

The decision to be a whistleblower is not easy. Mental trauma, the risk of retaliation, the potential loss of employment or ostracisation by work colleagues, not to mention the impact on one’s personal life, all weigh heavily on the individual who decides to speak out in support of the common good.
